1. Operator and scope
GetBelki.com and the Belki website are operated by Martin Aberastegue, Irmtraud-Morgner-Straße 11, 10318 Berlin, Germany (“Belki,” “we,” or “us”). Contact: hi@getbelki.com.
These terms apply to your use of the public website and to requests to join the early-access waitlist. A managed Belki subscription, if offered to you, will be governed by separate service terms presented before a contract is formed. The future self-hosted software will be governed by the licence published with its source code.
2. Business users only
The website and waitlist are intended exclusively for entrepreneurs, companies, public-sector organisations, and people acting for business or professional purposes. They are not offered to consumers within the meaning of section 13 of the German Civil Code (BGB).
You must be at least 18 years old. If you act for an organisation, you confirm that you are authorised to do so.
3. Website information and waitlist
The website provides information about Belki, planned managed plans, and a self-hosted edition being prepared for release. Joining the waitlist records your interest; it does not create a subscription, reserve capacity, guarantee access, or require either party to enter into a contract.
Before public checkout, plan descriptions and prices are informational and may be changed or withdrawn. Any binding price, service scope, billing term, tax treatment, and availability will be presented when managed signup becomes available.
Waitlist personal data is handled as described in our Privacy notice. You may leave the waitlist at any time by emailing hi@getbelki.com.
4. Acceptable use
You may use the website for lawful business information and evaluation. You must not:
- interfere with the website, Worker, waitlist endpoint, or security controls;
- submit another person's email address without permission;
- attempt unauthorised access, automated abuse, or harmful load testing;
- use website content in a misleading way or to imply endorsement by Belki; or
- violate applicable law or third-party rights.
Reasonable indexing by public search engines is permitted.
5. Intellectual property
The Belki name, website design, copy, graphics, product screenshots, and other website content are protected by applicable intellectual-property laws. Except where the law permits otherwise, you may not reproduce, distribute, modify, or commercially exploit them without prior permission.
The planned self-hosted application is separate from this website content. Source code becomes available under Apache 2.0 only when it is actually published with that licence. Nothing on this website grants early access to unpublished source code or provider credentials.
If you voluntarily provide feedback, you permit us to use it without restriction or payment, provided that we do not disclose confidential information you clearly identify as confidential.
6. Third-party services and links
The website may link to or load third-party services, including the Belki application, Cloudflare resources, supported capture and payment providers, and an optional YouTube demo. Those services are governed by their own terms and privacy notices. A link does not mean that we control or guarantee the third-party service.
7. Accuracy and availability
We aim to keep the website accurate and available but do not promise uninterrupted access or that all information will always be current, complete, or error-free. Product capabilities described as planned, future, “coming soon,” or subject to testing are not commitments to deliver them by a particular date.
You are responsible for evaluating whether information on the website is suitable for your business. The website does not provide legal, tax, or professional advice.
8. Liability
We are liable without limitation for intentional misconduct and gross negligence; for injury to life, body, or health; under the German Product Liability Act; and where we have expressly given a guarantee.
For slight negligence, we are liable only for breach of a material contractual obligation whose performance is essential to the proper fulfilment of these terms and on which you may normally rely. In that case, liability is limited to the foreseeable loss typical for this type of website relationship. Otherwise, liability for slight negligence is excluded to the extent permitted by law.
These limitations also apply to our agents and representatives. Mandatory statutory liability remains unaffected.
9. Changes to the website and these terms
We may change or discontinue website content and waitlist availability. We may also update these terms for future use. The version and effective date at the top identify the current terms. A change will not retroactively alter a separately concluded contract.
10. Governing law and venue
German law applies, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods. Mandatory rules that cannot lawfully be excluded remain unaffected.
If you are a merchant, legal entity under public law, special fund under public law, or a business without a general place of jurisdiction in Germany, the exclusive venue is Berlin, Germany, to the extent legally permitted.
